California Race Discrimination Lawyer

They say you shouldn’t judge a book by its cover, but sometimes employers do. It’s common for companies to treat applicants or employees unfavorably because of something as trivial as the color of their skin.

This is called race discrimination and it involves treating someone differently because of their race or personal characteristics associated with race, such as skin color, hair texture, or certain features. This type of discrimination or harassment is illegal when it comes to any aspect of employment, such as hiring, termination, pay, promotion, benefits, and training.

Harassment can include racial slurs, offensive remarks about a person’s race or color, or the display of racially offensive symbols. Race harassment becomes illegal when it is so frequent or severe that it creates a hostile work environment or causes the victim to get fired. The harasser can be the victim’s co-worker, supervisor, client or customer.

Race discrimination can also occur when someone is treated unfavorably due to association. For example, they may be married to or best friends with a person of a certain race or color.

Discrimination can happen even if the victim and the offender are the same race or color.

Unfortunately, some employers don’t like the way an employee looks. Even if the person is highly skilled and able to do their job well, the employer may still have issues. If you have faced harassment or discrimination, seek legal help from a California race discrimination lawyer from The Garza Firm. Our experienced team will guide you through the process.

Types of Race Discrimination

Race discrimination can occur in four different ways:

  • Direct discrimination. This happens when someone treats you less favorably than another person in a similar situation solely because of your race.
  • Indirect discrimination. This is when a company has a particular policy or way of working that puts people of a certain race at a disadvantage. An example would be a hairdresser who refuses to employ stylists that cover their own hair, which would put any Muslim women or Sikh men at a disadvantage.
  • Harassment. Harassment occurs when someone makes you feel humiliated or offended. An example would be someone calling their colleague a racist name. If the employee is insulted and offended by it, then it is considered harassment. Harassment can never be justified, so companies must do what they can to prevent it.
  • Victimization. Victimization is when you are treated badly because you have made a complaint of race-related discrimination or are supporting someone who has made a complaint of discrimination.
